Terms of Service

1. Acceptance of Terms

By accessing or using aichart (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. We reserve the right to modify these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

aichart is an online tool that allows users to generate animated “race chart” videos from user-supplied data files (CSV/XLSX) or text prompts. The Service uses third-party artificial intelligence APIs — including Google Gemini — to interpret, normalise, and generate data, and to produce video output. The Service is provided on an “as is” and “as available” basis.

3. Use of Artificial Intelligence

The Service relies on AI models to process inputs and generate outputs. You acknowledge and agree that:

  • AI-generated content may be inaccurate, incomplete, or misleading. You are solely responsible for reviewing, verifying, and validating any output before use.
  • Your inputs (uploaded files and text prompts) may be transmitted to third-party AI providers for processing in accordance with those providers' own terms and privacy policies.
  • You must not submit inputs that are unlawful, confidential, or that you do not have the right to disclose to third-party AI providers.
  • We do not guarantee that any specific AI model or provider will be available at any given time, and we may change AI providers without notice.

4. User Content, Data, and Licence Grant

You retain ownership of any original data you upload. By submitting any content — including uploaded files, text prompts, and the resulting generated outputs — you grant aichart a worldwide, perpetual, irrevocable, sublicensable, royalty-free licence to use, reproduce, store, adapt, modify, distribute, and otherwise process that content for any purpose, including but not limited to:

  • Operating, maintaining, and improving the Service;
  • Reviewing submitted inputs and generated outputs to evaluate quality, safety, and accuracy;
  • Training, fine-tuning, or evaluating machine-learning models used in or related to the Service;
  • Developing new features, products, or services;
  • Aggregating and anonymising data for analytics and research.

This licence survives termination of your use of the Service. You waive any moral rights or equivalent rights in submitted content to the extent permitted by applicable law.

You represent and warrant that you have all necessary rights, consents, and permissions to upload any data you submit, and that doing so does not violate any applicable law or third-party rights.

5. Ownership of Generated Output

Subject to your compliance with these Terms, you own the video files generated from your data and may use them for any lawful purpose, including commercially. aichart claims no intellectual property rights in the generated output.

6. Prohibited Uses

You agree not to use the Service to:

  • Generate content that is defamatory, fraudulent, harassing, obscene, or that violates any law;
  • Upload data that contains personal information of third parties without their consent;
  • Attempt to reverse-engineer, scrape, or overload the Service;
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity;
  • Use the Service in any manner that could damage, disable, or impair the Service or interfere with other users.

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. AI-GENERATED CONTENT IS NOT PROFESSIONAL FINANCIAL, LEGAL, MEDICAL, OR OTHER ADVICE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AICHART, ITS OPERATORS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD 10.

9. Indemnification

You agree to indemnify, defend, and hold harmless aichart and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third-party right.

10. Eligibility

You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time and for any reason, including violation of these Terms, without notice or liability. Sections 7, 8, 9, and 12 survive any termination.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration or, where arbitration is not enforceable, to the competent courts of the jurisdiction in which the operator resides, and you consent to the exclusive jurisdiction of such courts.

13. Changes to These Terms

We may update these Terms from time to time. The “Effective date” at the top of this page indicates when the Terms were last revised. We encourage you to review these Terms periodically. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
